Conservation Commission Minutes 01/19/11
FINAL
Present for the Conservation Commission and attending the meeting were:  Pam Goff, Sandy Broyard, Dick Smith, Bruce Bartels and Chuck Hodgkinson.  Also attending were Chris Alley, Kris Horiuchi, Reid Silva and Matt Flanders.  Andrew Fischer, Richard Steves, Caitlin Jones, Donald Poole and Virginia Dyer were absent.

The meeting came to order at 12:30 PM.  Ms. Goff was appointed as acting Chair.  The site visits for today were made on January 18.

NOI SE 12 - 620; MATT FLANDERS FOR GUY WEBSTER; 14 Carroll Lane;         Map 27.1 Lot 174:  Ms. Goff opened the public hearing at 12:30 PM.  Mr. Flanders summarized the plan to expand the current brush pruning area to open the water view.  The vegetation will be pruned to the height of the power lines and done in the fall season.  Chain saws and hand tools will be used for the work in the buffer zones of a salt marsh and wetland.  They would also like to continue maintaining the meadow by mowing it once per year between October15-April 15.  This is renewing the expired Order of Conditions for SE 12 – 262.  The meadow maintenance also has an isolated wetland and buffer zone.  The applicant further requests an on-going condition be granted for perpetual view and meadow maintenance provided the contractor reviews the maintenance plan with the Conservation Agent before maintenance work begins.

Mr. Flanders added that Prudence Whiting has given written permission for light pruning on her property--Map 27.1 Lot 206--to improve the water view of the Basin.  The Commission confirmed that the mowing will not take place during the growing season.  It also pointed out the wildlife values of the meadow buffer zone and isolated wetland resource.  Mr. Flanders agreed.  With no questions from the audience a motion was made to close the hearing at 12:37 PM.  The motion was seconded and unanimously approved with four in favor.  

A subsequent motion was made to approve the plan as presented with the following special conditions:  1. The meadow mowing and pruning for view maintenance as outlined in the Webster Residence Work Description is allowed in perpetuity provided the conditions of this Order are met at all times.  2.  The meadow shall be mowed once per year between the dates of 10/15 and 4/15.  3.  The applicant shall review the maintenance plan with the Conservation Agent before work begins.  The motion was seconded and with no discussion approved unanimously with four in favor.  

RFD CHRIS ALLEY FOR SONGWIND, LLC; AP 27.1-86:  Mr. Alley summarized the plan to install a split rail fence to disuade public use of the private property.  The work will be done in the buffer zone of a salt marsh and Menemsha Creek.  The closest activity is approximately 2 feet from the salt marsh and 5 feet from Menemsha Creek.

The Commission inquired about lateral access across the dock as required in the     Chapter 91 license.  Mr. Alley said the approved license and plans indicate lateral access stairs between the mean high and low water marks.  He added they were never installed.

The Commission commented there will be minimal disturbance as the fence will be installed by hand and the split rail fence may provide additional protection for the salt marsh.  A subsequent motion was made for a negative determination with the following condition:  1.  The lateral acess stairs will be installed on the water side of the existing dock gate--as shown on the Chapter 91 license plans--before the split rail fence is installed.  The motion was seconded and unanimosuly approved with four in favor.

CERTIFICATE OF COMPLIANCE SONGWIND, LLC; SE 12 – 565; AP 27.1-86:  Mr. Alley summarized the Order of Conditions issued to repair the pier, install water and electric service, install a split rail fence along the north, south and east boundaries and grade the parking area.  The Commission agreed all work has been copmpleted except the installation of the permanent signage prohibiting the use of soaps or detergents.  Mr. Alley mentioned the sign is on order and will be installed as soon as it arrives.  Chuck H. will be notified when it is ready for inspection.  A motion was made to postpone the approval of the Certificat of Compliance until all conditions in the Order have been satisfied.  The motion was seconded and unaimously approved with four in favor.

FOLLOW UP SITE PLAN GRIN ACRES FAMILY LP; SE 12 – 619;                    AP 21-10, 13, 14:  Ms. Horiuchi presented a revised site plan for relocating five of the total ten red cedar trees that were approved for planting in the buffer zone.  The five relocated trees were removed from the wetland as conditioned on January 5.  After brief discussion a motion was made to approve the revised site plan dated 1/18/11.  The motion was seconded and unanimosuly approved with four in favor.

DISCUSSION CHRIS ALLEY FOR MAP 33 LOT 66:  Mr. Alley reviewed the options for rebuilding the raised walkway and fixed pier that was licensed in the 1960’s but never maintained.  After discussion the Commission thought it would entertain the proposed seasonal extension supported on pipes in lieu of the cantelevered design.  The Commission reminded Mr. Alley that he will need to file a Notice of Intent and these comments are not binding.  Mr. Alley concurred.

ADMINISTRATION:  
The 2010 Annual Report was reviewed and approved by consensus.
